SAME SEX Marriage News: When the verdict was pronounced on Tuesday (October 17) regarding gay marriage, the right to adopt the child can be given the right to adopt.However, after the decision, it became clear that the court would not allow it to be done.A bench of five judges of the Supreme Court gave four decisions.Two of the five judges remained in favor of giving the right to adoption, while three judges refused to do so.Chief Justice DY Chandrachud and Justice Sanjay Kishan Kaul agreed to give gay couple the right to adopt a child.But Justice S. Ravindra Bhat, Justice Hima Kohli and Justice PS Narasimha disagreed on it.The Chief Justice said at the beginning of his decision that the back of five judges will give four different decisions.He said that we agree on some things and not on some.In this, an disagreement was over the right to adopt a child.What issues did the back agree on?As the four decisions were read in the Supreme Court.This made it clear that all the judges in the bench agree that the issue of giving legal recognition to gay marriage should be left to the legislature.The Special Marriage Act cannot be canceled for this.The bench also agreed to instruct the government to form a committee, whose job would have to solve the problems related to gay couples.What did the Chief Justice say on adoption?CJI Chandrachud said in his judgment that unmarried couple including gay couple should get the right to adopt a child.Under the law, it should not be assumed that only male-women pair can become a good parent.Thinking like this is like discriminating against gay couple.The CJI in its judgment mentioned the guidelines of the Central Adoption Resource Authority (CARA) and said that the Juvenile Justice Act does not stop the adoption of unmarried couples.The Chief Justice said that CARA has no purpose to distinguish between married couples and unmarried couples.Its rule has not been said that doing so is in the best interest of the child.He said in his decision that it cannot be assumed that unmarried couple is not serious about their relationship.There is no evidence that the couple of married male and women are able to provide more stability to the child.ALSO READ: ‘Neither child adoption, nor allowed marriage …’, Read 4 decisions of 5 judges of Supreme Court on gay marriage
