The Supreme Court on Tuesday (12 September) postponed the hearing on the petition of Umar Khalid, an alumnus of Jawaharlal Lal Nehru University (JNU), for four weeks, in which Khalid made Khalid anti -terrorism in the riot case in North East Delhi in February 2020The law was requested for bail in the case registered under UAPA.A bench of Justice Anirudh Bose and Justice Bella M. Trivedi said that a detailed hearing in the case is needed.The bench told Khalid senior advocate Kapil Sibal, ‘We have to see one document in this case.You should file material related to the evidence available in relation to the allegations.Supreme Court Justice Prashant Kumar Mishra had separated himself from hearing Khalid’s petition on 9 August.Khalid’s petition challenged the order of Delhi High Court on October 18, 2022, which dismissed his bail plea in the case and Justice A.S.Bopanna and Justice Prashant Kumar Mishra came before the bench.The petitioned court had earlier rejected Delhi HC. The court had dismissed Khalid’s bail plea saying that he was in constant touch with other co-accused and the charges against him were prima facie correct.The High Court also said that prima facie it seems that the actions of the accused fall under terrorist acts under the illegal activity (prevention) Act.Khalid, Sharjil Imam and many others have been booked under several provisions of the UAPA and Indian Penal Code on charges of being the main conspirator of February 2020 riots.53 people were killed and more than 700 were injured in this riot.The violence erupted during the protest against the amended Citizenship Act (CAA) and the National Civil Register (NRC).Arrest was made in September 2020, Khalid, who was arrested by the Delhi Police in 2020, requested bail on the grounds that he had neither a criminal role in the violence nor had any conspiracy relationship with any other accused in the case..The Delhi Police opposed Khalid’s bail plea in the High Court, saying that his speech was highly planned and raised controversial issues like Babri Masjid, triple talaq, Kashmir, alleged repression of Muslims, CAA and NRC.Also read: IMEC Project: India’s IMEC in front of China’s BRI: Dragon stuck in Ajit Doval’s ‘Chakravyuh’
